First Offense (within 10 years) – Varies for probation or without probation

  • Alcohol and drug program
  • Fine of $390 to $1,000
  • Various penalty assessments
  • 48 hours to 6 months in jail (increased if child was in vehicle)
  • 6 months license suspension
  • Restricted license for going to and from work
  • Impound vehicle for 6 months
  • Ignition interlock device for up to 3 years

 

Second Offense (within 10 years) – Varies for probation or without probation

  • Alcohol and drug program for 18 to 30 months
  • Fine of $390 to $1,000
  • Various penalty assessments
  • 96 hours to 1 year in jail (increased if child was in vehicle)
  • 2-year license suspension
  • Restricted license for going to and from work after 1 year of suspension
  • Impound vehicle for 6 months
  • Ignition interlock device for up to 3 years

 

Third Offense (within 10 years) – Varies for probation or without probation

  • Alcohol and drug program for 18 months if you didn’t already take one
  • Fine of $390 to $1,000
  • Various penalty assessments
  • 120 days to 1 year in jail (increased if child was in vehicle)
  • 3-year license revocation
  • Impound vehicle for 6 months
  • Ignition interlock device for up to 3 years
