First Offense (within 10 years) – Varies for probation or without probation

- Fine of $390 to $1,000
- Various penalty assessments
- 48 hours to 6 months in jail (increased if child was in vehicle)
- 6 months license suspension
- Restricted license for going to and from work
- Impound vehicle for 6 months
- Ignition interlock device for up to 3 years

Second Offense (within 10 years) – Varies for probation or without probation
- Alcohol and drug program for 18 to 30 months
- Fine of $390 to $1,000
- Various penalty assessments
- 96 hours to 1 year in jail (increased if child was in vehicle)
- 2-year license suspension
- Restricted license for going to and from work after 1 year of suspension
- Impound vehicle for 6 months
- Ignition interlock device for up to 3 years

Third Offense (within 10 years) – Varies for probation or without probation
- Alcohol and drug program for 18 months if you didn’t already take one
- Fine of $390 to $1,000
- Various penalty assessments
- 120 days to 1 year in jail (increased if child was in vehicle)
- 3-year license revocation
- Impound vehicle for 6 months
- Ignition interlock device for up to 3 years
